SPEAKINGO Terms of Use and Privacy

Welcome! These terms cover the SPEAKINGO website and mobile app. You receive the offer details before buying. This version applies to new contracts from publication; previously acquired rights remain protected. The privacy information describes our current processing.

1. Who runs SPEAKINGO?

2. How do you learn?

Dr Grzegorz Kuśnierz, who holds a doctorate in English studies, developed the course methodology. You learn by speaking with software, listening and repetition. Lessons are not taught live by a person. Access includes lessons, AI conversations and exercises, dictation, tests and additional materials. AI characters are virtual. AI and speech recognition can make mistakes: please report them. Exercise results guide learning and are not official proficiency certificates. We do not guarantee a particular result within a particular time. This does not limit our responsibility for the service conforming to the contract.

AI does not replace a doctor, psychologist, lawyer or financial adviser, regardless of the character's name. Do not enter passwords, payment details or confidential information about yourself or others. Practise with fictional examples. Do not use the service unlawfully.

3. Your account and devices

Registration requires an email address, password and acceptance of these terms. We may ask you to verify your email. One account is for one person, on up to five supported devices. Protect your password and tell us if you suspect unauthorised access. If you lack full legal capacity, seek a parent or guardian's assistance where legally required.

You need internet access, a supported device and audio playback; speaking exercises require a microphone and permission to use it. We recommend an up-to-date Chrome browser; app requirements appear in its store listing. We describe material feature differences, requirements and limits before purchase. Install necessary updates; their importance and the consequences of not installing them are explained in the notice or update description. Trial scope and duration are shown at the start. The trial lets you check your equipment, does not remove consumer rights and does not itself start a paid subscription.

4. Access and payments

One purchase covers all available languages and features for the paid period, using the same account on the website and app. This also applies to existing customers with active paid access. A language launched during that period, including Polish, is included without extra charge. An announcement does not mean a course is already available. Content and exercises vary by course and device; advertised limits cannot be changed arbitrarily against purchased access.

Purchasing Premium disables advertising in the SPEAKINGO mobile app and on the website for the duration of active access, when signed in to the account with that access. This also applies to Premium access granted by redeeming a gift voucher.

Before payment we show the total price, currency, period and renewal rules. Website and app-store prices and promotions may differ; the offer for your purchase applies. One-off payments do not renew. Subscriptions renew as offered until cancelled. Cancel a website subscription in your profile; cancel App Store or Google Play subscriptions in that store's subscription settings. Paid access remains until the period ends. Uninstalling does not cancel a subscription or delete your account. After access expires you can still open your account and buy further study; paid features require active access.

Payments are processed by Stripe, Przelewy24/PayPro S.A. and the relevant app store. Available methods appear at purchase. Contact us if charged without access being granted. We issue invoices upon receiving the necessary details. Access codes follow their offer; unless otherwise stated, activate them in your profile within two years of issue, with access running from activation. You may give away an unused code unless personal or prohibited by its offer. Report problems to the code seller or us; statutory rights remain unaffected.

5. Cancellation and complaints

We offer no voluntary money-back guarantee for changing your mind, stopping study or not using correctly provided access. This does not restrict statutory withdrawal or complaint rights.

Consumers buying online generally have 14 days from concluding the contract to withdraw without a reason. A trial, accepting these terms or using the service does not itself remove this right. Exceptions for digital content or fully performed services apply only when all legal requirements are met, including appropriate prior declarations, information and confirmations. We do not presume automatic compliance.

Send withdrawal to info@speakingo.com or the address in section 1 before the deadline. A clear statement identifying the purchase is enough. You may use this form: MODEL WITHDRAWAL FORM (TXT). On valid withdrawal, we make the refund due within 14 days, using the original payment method unless you agree to another cost-free method. A charge for services already provided is possible only under statutory rules, following the required express request to start and provision of information. App-store procedures do not restrict your statutory rights.

If the service does not conform to the contract, email your account details, the problem and the remedy sought. We reply within 14 days. You may request conformity and, where legally available, a price reduction or withdrawal. You need not wait for five days of outage. Consumer advisers can help; information about out-of-court dispute resolution: UOKiK. Court proceedings remain available.

6. Materials and messages

Rights to the software, brand and materials belong to us or their respective authors. Use materials for personal study; you may download and print files made available. Do not distribute paid content or resell access without authorisation. Separate licences and statutory permitted uses remain valid. We do not automatically claim copyright in every AI response. Posting a comment allows its display, not automatic transfer of copyright. We may remove spam and unlawful content.

The newsletter requires separate, voluntary consent. Unsubscribe using the email link or contact us, without losing learning access. Account, security, payment and contract messages are independent of the newsletter. Send learning and support questions to info@speakingo.com.

7. Your data

The business in section 1 is the controller. We process account and contact details, settings, access and transactions, progress and results. AI features involve your messages, responses, summaries and exercise context. Technical data, including IP and device information, support operation and security. Automated scores aid learning, not decisions with legal or similarly significant effects.

We send conversation content and necessary context to OpenAI; SPEAKINGO also stores history and results. Voice may be processed by your browser or device's speech-recognition provider, such as Google or Apple. Text read aloud also goes to Google's voice service. We use hosting and email providers, payment processors, stores and your selected Google/Facebook login. Authorised staff have access as required for their tasks. For organisational courses, the organisation may receive participant details and progress as explained on joining; this does not automatically include full AI conversations.

GDPR bases: account and ordered learning — contract performance, Article 6(1)(b); legal duties — (c); necessary security and legal claims — legitimate interests, (f); voluntary purposes, such as optional analytics — consent, (a). Required data are necessary for the account or chosen feature; other choices are voluntary.

We retain account and learning data as needed to maintain your account and continue learning. When the purpose ends, we erase or anonymise them, except where needed for legal duties or claims. Transaction records follow tax and accounting retention periods; consent-based data are kept until withdrawal or an earlier end of purpose. Providers may retain data necessary for services, security and legal duties. We do not promise one period for all data or completely anonymous conversations.

You may request access, correction, erasure, restriction or portability, object and withdraw consent, as applicable to the legal basis and circumstances. Withdrawal operates for the future. You may complain to the President of Poland's UODO. Request account or history deletion by email, preferably from your account address; we may verify your identity. Never send your password. Accounts are deleted on email request; uninstalling does not erase data. Cancel store subscriptions separately in the store.

Global providers may process data outside the EEA. Transfers require safeguards, such as an adequacy decision or standard contractual clauses. Email us for information or a copy of safeguards. Provider information: OpenAI, Google, Apple, Meta / Facebook, Stripe, Przelewy24 / PayPro.

8. Cookies and privacy choices

Cookies and similar storage support login, security, payments and saving choices. Optional SPEAKINGO/Google Analytics requires consent. Selected pages show Google AdSense and partner ads according to the consent panel settings. Clicking a YouTube/Vimeo video sends technical data, including IP, to the provider and may activate its cookies; this does not itself enable SPEAKINGO analytics.

Accepting terms, buying or scrolling is not consent to optional cookies. Change choices using the cookie-settings button without losing your account or paid access; the page may reload. The choice is shared between the website and student panel in that browser; it does not replace app settings or microphone permissions. Another device may ask again. Session cookies expire with the session; others follow their lifetimes. Current GA cookies last 182 days, potentially renewed; Stripe security cookies __stripe_mid last one year and __stripe_sid 30 minutes. Device lifetimes are not server-data retention periods. See the consent panel and SPEAKINGO — cookies for purposes, partners and choices. Blocking necessary cookies may affect login and payments.

9. Changes and other terms

Service changes may address bugs, security, development of materials, law or supported systems. Changes beyond maintaining conformity are made only for these justified reasons, within the law and without extra cost. We explain them clearly. For a material negative effect on paid service, we email advance information about scope, timing and rights. You may terminate without notice within 30 days of the change or a later notification; unused periods are settled as required by law. This does not apply if you can keep the unchanged, conforming service free of extra charge.

Terms may change for legal changes, clarification or the service changes described above. New offers do not remove earlier access or change the price of an already paid period. Publishing a text does not replace required consent. If ending the service, we give advance notice and settle the undelivered part; we do not charge for unavailable service. Organisational contracts may have individual terms, without excluding mandatory rights. Polish law applies while preserving mandatory consumer protections applicable in your country of residence. Nothing excludes rights that cannot lawfully be excluded.
